Welcome to Aspen Labs ("Aspen," "we," "our," or "us"). By accessing or using our website, purchasing our products, or otherwise interacting with our services, you ("you" or "customer") agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our site or purchase our products.

You must be at least 18 years of age, or the age of majority in your jurisdiction, to place an order. By purchasing, you represent that you meet this requirement and that the payment information you provide is accurate and belongs to you.

Firmer by Aspen is a topical cosmetic product intended to improve the appearance of skin. It is not a drug and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Statements on our site describe the look and feel of skin. Individual results vary.

Always review the ingredient list before use. Discontinue use and consult a qualified medical professional if irritation occurs. Patch-test before first use if you have sensitive skin.

All orders are subject to acceptance and product availability. Prices are listed in U.S. dollars unless otherwise noted and may change at any time without notice. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, or violations of these Terms.

Checkout is processed by Shopify. By placing an order you also agree to Shopify's applicable terms. Sales tax and applicable duties are calculated at checkout where required.

Estimated delivery windows shown on the site are provided in good faith but are not guarantees. Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for carrier delays, incorrect shipping information you provide, or packages lost after confirmed delivery.

We offer a 60-day satisfaction guarantee on your first bottle of Firmer. If you are not satisfied within 60 days of delivery, contact us at teamaspenlabs@gmail.com with your order number to request a refund of the product price. Shipping fees are non-refundable. Refunds are issued to the original payment method within a reasonable processing window.

All content on this site - including the "Aspen," "Aspen Labs," and "Firmer" names, logos, product photography, text, graphs, illustrations, and formulations - is owned by or licensed to Aspen Labs and protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission.

You agree not to misuse the site, attempt to gain unauthorized access, interfere with its operation, submit false information, resell products without authorization, or use the site for any unlawful purpose.

If you submit a review, testimonial, photo, or other content, you grant Aspen Labs a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business, including in marketing materials. You represent that you own or have permission to share what you submit.

The site and products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that results shown on the site will be replicated for every user.

To the fullest extent permitted by law, Aspen Labs and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

You agree to indemnify and hold Aspen Labs harmless from any claim, loss, or expense (including reasonable legal fees) arising from your violation of these Terms, your misuse of the site or products, or your infringement of any third-party rights.

Our site may link to third-party sites or use third-party services (including Shopify for checkout and Meta for analytics). We are not responsible for the content, policies, or practices of those third parties.

We may update these Terms from time to time. The "Effective" date above indicates the latest revision. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the United States and the state in which Aspen Labs is organized, without regard to conflict of laws rules. Any dispute not resolved informally will be brought exclusively in the courts located in that jurisdiction, and you consent to their personal jurisdiction.
